Its surprising how much you can accomplish if you don't care who gets the credit
Nobody believes these laws are constitutional. Yet none of our legislators will approve any bills that would correct the problem. Bills have been presented, but killed by the legislature by pressure from the DA and Police lobbying groups. Many departments depend on income from asset forfeiture to keep their budgets inline to operate. I personally believe this type of police action is what turns the public against the police.
Here is a link to an article where a former DOJ official speaks about how it is being abused. I hope you find it enlightening.
I've attached a PDF of a 2016 version that failed to pass. You can see the attempts to correct the flaws.
I've also attached a PDF of the Fiscal Year 2016 Arizona RICO fund report. This data is public and shows the kind of monies that it generates. Many seizure occur without any kind of intent to press charges or to prosecution. To add insult to injury the laws in Arizona make someone attempting to get their property back liable for the states expense if they lose, which is inevitable. This is usually more than the property is worth.
It would be nice to know how many are never charged or prosecuted That data seems to be copiously hidden from us.
