Its surprising how much you can accomplish if you don't care who gets the credit
Have you ever been hit squarely in the face with a 2 X 4 by politicians claiming to be “on your side”? I’m speaking in figurative terms of course about behaviors of local AZ State officials claiming to be “Conservative”. One of the basic tenets of the Republican platform is adherence to our Constitution as intended by our founding fathers. Democrats however view our Constitution as a “fluid” document that should be altered according to the whims of their ever changing ideology. Unfortunately there exists a class of Republican politicians who oftentimes mirror Democrats in the perpetual exercise of trying to “tweak the system”.
RINO’s (Republicans In Name Only) live among us, attend our meetings, affect legislation and attempt to convince that they’re “on your side” while simultaneously shoving a dagger deep into the backs of voters who expect honest representation. One recent example of RINO’s helping Democrat/Socialists in making a mockery of State and Federal Immigration Law was the recent edict by ABOR (AZ Board of Regents) in granting a “special discounted” tuition rate to Illegal Alien students wishing to attend AZ universities and colleges! The tuition would be less than that paid by out of state students who are US citizens! I’m not joking! The following is an abbreviated version of the steps leading up to this stunt:
In the previous legislative session AZ State Senator Heather Carter (LD-15) colluded with another “Republican”, AZ State Rep Michelle Udall who “represents” LD-25. They went about the business of crafting two Bills (SB 1217 and HB 2186) that would have opened the door legislatively to “welcoming” Illegal Aliens residing in AZ for the special discounted tuition. Thankfully, Senate and House Republican leaders saw through the ruse and shelved both measures. These bills were in obvious violations of both AZ and Federal statutes prohibiting special “accommodations” to those who reside in our state illegally.
However, the legislative rejection of these measures did not dissuade Ms. Carter. She was undeterred in getting her agenda approved, regardless of party standards regarding Illegal Immigration. All was quiet for the following few weeks after the legislative session had ended. On August 22, 2019 a political bomb was detonated (https://ktar.com/story/2700528/arizona-extends-special-tuition-rate...). ABOR (AZ Board of Regents) had just announced policy to accommodate Illegal Aliens by offering them a “special category” of discounted tuition that would be “effective immediately”. Coincidently this decision mirrored the provisions of the two failed Carter/Udall bills providing similar benefits to our Illegal friends. I can imagine the back door dealings that had been going on during this “quiet period” by the named esteemed legislator (s) and corrupt ABOR officials.
RidersUSA decided to become active in this arena and began an email and letter writing campaign to convince the AZ Attorney General to take legal action against ABOR for violating State and Federal Statutes. The return email from the Attorney General was eye opening. Apparently his office could not proceed with any legal action against ABOR because of a 1960 AZ Supreme Court decision prohibiting the AG from suing this particular agency. What??!!! The AG is now in the process of appealing the 1960 decision in hopes that the present Supreme Court would reverse the previous ruling and allow the AG to do his job.
In the “back and forth” between emails and phone calls I became aware that Republican Governor Doug Ducey had appointed all 8 members of ABOR and agreed with ABOR’s decision to provide the discounted tuitions for Illegal Alien students as well. With Republicans like this doing the work of Democrats………………..why do we need Democrats???!!!
I hope this extreme Wrong will be defeated. They say Good always triumphs!! No question, Ducey is a Rino, "A sheep in wolves clothing."
I like the reverse spin you applied to this cliche. It can be used either way....LOL!
There is not any reason to sue the Board. Any misuse of public money or failure to uphold the law is a crime/tort committed by the individuals on that board and is not covered by their membership but by their own finances. It should not fall on the States funds to pay for wrong doing by these individuals. The suit should be against the individuals with them paying the bills for the legal battles and damages.
Legal strategies in how to deal with this insult to the legal citizens of Arizona are beyond my pay grade. However, I can assure you that a response to this obvious end run around State and Federal Immigration law will be forthcoming!
I feel that Arizona voters regularly get hit squarely in the face with a 2 X 4 by politicians.
Thank you for this post. Blindsighted is fast becoming a theme in Arizona politics. The same run around play is being executed by AZ liberals and the new Superintendent of Public instruction. Hoffman created a new diversity position and contracted with a uber left organization to teach social justice warfare to students. In the previous legislative session, the legislature capitulated to liberals in a last minute end run around clear AZ statutes prohibiting LGBT instruction in the classroom. (Keep an eye on what your students don't bring home as homework.)
Liberals constantly sue the state for the slightest issue. It's a good time for the "officials" involved in this ABOR decision to hear from tens of thousands of voters. If the AG can't sue ABOR, then another entity can. There's always more than one way to "skin a cat."
Joann; Don't sue ABOR. We should all join together and go after the individuals and their bank accounts for the misuse of public/our money. Whats the point of one agency of the state suing another. If there is wrong doing it is the individuals doing that the Board is only allowed to do legal things not illegal things. If they break the law or do wrong it is on them not the state. Lock up their homes and assets in a law suit and they may not wish to continue to do wrong things. As long as the bill is on us what do they care?
For clarity, I'm not a lawyer, just a civilian citizen and lover of my state. However, I believe ABOR can be slapped with an injunction (lawsuit) so that taxpayers are not burdened while decades old legislation is considered for repeal. I agree with you in the case of corruption, the individual should be held liable. Taxpayers still have to deal with the fallout though—illegal programs.
This is corruption! They are spending taxpayer/State money on something the law said they can not. They are misusing public money by giving what amounts to a subsidy to those they wish to promote. If they break the law "under color of Law" it is not legitimate at all.
Acting under color of [state] law is misuse of power, possessed by virtue of state law and made possible only because the wrongdoer is clothed with the authority of state law Thompson v. Zirkle, 2007 U.S. Dist. LEXIS 77654 (N.D. Ind. Oct. 17, 2007)
They need to include in that all who voted 4 SB 1469, Red 4 Ed, NPV, removing laws this last session that protected our children from being brainwashed in our schools and they all voted 4 it as AZ AG told them we couldn't win in Court, is he a fortune teller or just another Traitorous Office Holder.
Lets have a real House & Senate Cleaning and find people to run against them and yes of course Fund them as the Left GOP always has the DOLLARS needed to keep them in and promote them from here to DC.
God Bless You All; Clair Van Steenwyk
What court did he mean "we couldn't win" in? Our elected are not the best and brightest in many cases, yet we keep sending the same into the halls of government to do our business for us. The AG may not have a firm grasp of the Constitution, most lawyers don't. If he is sending his team into the local federal courts to defend against lawsuits regarding laws passed by our legislature we might want to find a replacement for him. As far as the AG telling the Legislature what to do that is on the people we elect to our legislature they should know better.
AG Brnovich was referring to the SCOTUS as he's not the best lawyer in the state and recall when Horn was AG we went to the SCOTUS and won, but then the GOP Elites wanted him out and put in someone they could control from the top down. Our Legislators as has been pointed out have taken orders for yrs. if not decades as they all want to be promoted etc. and as they told Randy Miller you don't know how it's done at the Capitol when he exposed their bad Votes, I've been told that several times by State and Federal Office holders and have known it's true before they were dumb enough to say it, but then as you said not the best or brightest.
God Bless You; Clair Van Steenwyk
I agree with you, but let the "court" do their job and let the Legislative do theirs. If they are going to back down before a fight we don't need them at all they become a detriment to the process and not a solution in any terms. If they take their orders from the Gov or AG they aren't doing their job and need to be retired to some place they can't affect the legitimate processes of Government.
