ABOR CONTINUES ITS CRIMINAL ACTIVITY

The Arizona Board of Regents (ABOR) has become a criminal enterprise. In their most recent Board Meeting, August 22, 2019, ABOR members voted to allow illegal aliens lower tuition to attend our state’s universities -- directly in opposition to the Arizona Constitution and state statutes and against the will of Arizona taxpayers and voters.

In 2006 Arizona voters made it abundantly clear when they passed Proposition 300 by over 70%, including a majority of Republicans, Independents and even Democrats, that illegal aliens were prohibited from receiving taxpayer benefits including adult education. The pertinent language is this: “A person who is not a citizen of the United States, who is without lawful immigration status . . . in this state is not entitled to tuition waivers, fee waivers, grants, scholarship assistance, financial aid, tuition assistance or any other type of financial assistance that is subsidized or paid in whole or in part with state monies.”

There is no ambiguity; it is more than clear that Arizonans oppose giving a tuition break to illegal aliens. It doesn’t matter if they are DACA kids (which is also an illegal designation) or if they illegally came over the border and attended an Arizona high school for the required three years -- it doesn’t matter! And it is more than clear that ABOR members have decided they don’t care what you think or want. And they don’t care about the State Constitution or state statutes.

State Senator Heather Carter (R-Dist 15) already tried this end-run around Arizona citizens in the last legislative session. She proposed SB1217 which is essentially a mirror image of ABOR’s recent illegal actions. Thankfully that got shot down. But, the elites always think they know better than the rest of us unwashed, ignorant Normals, so they are trying another end-run around Arizona citizens.

In addition to their blatant disregard for the Arizona Constitution and statutes, ABOR is also in violation of federal law. Title 8, U.S.C. 1324(a) defines several distinct offenses related to illegal aliens, including Subsection 1324 (a)(1)(A)(iv) Encouraging/Inducing illegal aliens to reside in the United States. Allowing illegal aliens access to lower tuition certainly encourages and induces them to stay here.

Here are the members of ABOR who need to be held criminally and personally liable for these unconstitutional actions: Larry E. Penley (Chair), Karrin Taylor Robson, Ron Shoopman, Lyndel Monson, Bill Ridenour, Ram Krishna, Jay Heiler, Fred DuVal, Lauren L’Ecuyer, and Anthony Rusk.

Attorney General Mark Brnovich needs to file suit against each of those who voted for this public outrage. And where is Governor Doug Ducey? As an ex-officio member of the Board and as the person responsible for appointing many of these lawbreakers, he needs to step up and call them out. The citizens of Arizona have spoken -- the governor needs to speak up as well. And AG Brnovich -- do your job!

AFA Note:  Pardon our mirth at that last command: AG Brnovich - do your job!  We are trying to remember when the AG did his job in a timely manner.  We have searched but cannot find a time where he took action on a signifcant issue.  Reports is that his office received in excess of $500,000 to use for election integrity.  Waiting.  Waiting.

To violate one law so important is to violate all laws that secure our State and Nation's sovereignty.

Government MUST BE limited, and when it's not this is .. the means that justifies the ends ... a Marxist autocratic statist collectivism.  To "do your job" is to protect the taxpayers who fund this action by The Arizona Board of Regents. There was a Trump 2020 rally this past weekend at the Snowflake/Taylor rodeo grounds. At that rally I ran into Arizona Senator Sylvia Allen and Representative Anthony Kern. After discussions with these legislators about the aforementioned subject matter both had promised that they would be contacting  Attorney General Brnovich to insist that he file legal action against ABOR. We can never allow these type of Illegal and anti-American activities to go unchallenged! I plan on following up with both Allen and Kern to find out what they learned from their communications with Brnovich. Other legislators and Brnovich will be contacted as well. Tuition rates more favorable to Illegal Aliens than they are to our own American citizens should never have been entertained to begin with. This class of law breakers need to be deported and not coddled! We need to apply pressure on our elected representatives to impress upon them that these actions perpetrated by ABOR will not be tolerated!!!
