Arizona Citizens Supporting Honest Representative Government At All Levels
In 2010, the idea of banning ballot harvesting was a hot topic in Arizona. AFA was on it and others were too. A tiny handful of patriots realized the damage being done by ballot harvesting... including the Republican Recorder of Maricopa County.
How things have changed. In 2012, then Senator Reagan was asked by patriots to stop ballot harvesting through legislation. She liked that idea and wrote a bill. Unfortunately, that was the year when several election bills were on the table and the bumfuzzled legislation tried to bundle them into one bill and created a crazy quilt that collapsed before them.
When Reagan became Secretary of State in 2015, these same two patriots went to visit her in her office. She was asked to urge the Legislature to run another bill. They did. It turned into a giant unwieldy sausage. It was so bad, the republicans actually repealed the bill immediately next session. However, the legislature realized that banning harvest ballots, often from unsuspected voters was not the way early ballots were intended. Thanks to Michelle Ugenti took up the banner and got a good bill passed and signed into law. Viola`!
Not so fast. Since it was the brain-child of the democrats, they were not going to sit still watching their ballot baby get shot down. After all, that is the only way any democrat got elected! They took that bill to court. They lost in the AZ Supreme Court.
Undeterred, they appealed to the liberal 9th court where a panel of judges agreed with the AZ Supreme Court and upheld the bill. Proving the squeaky wheel gets the grease, another appeal was launched in the 9th until it finally got a hearing before all the judges in the 9th. Only then, packed with democrat judges, did the bill get overturned.
Enter AZ AG Mark Brnovich. He then appealed the bill the the U.S. Supreme Court. We who were involved in that bill waited breathlessly for months to know whether the Supremes would take the case.
Today, thanks to the perseverance of the Election Integrity Project California on behalf of CA and Election Integrity Project Arizona, some wonderful lawyers, who filed Amicus Briefs on the bill, the Supreme Court granted Certiorari to Brnovich's appeal. What does that mean?
It means a writ (order) of a higher court to a lower court to send all the documents in a case to it so the higher court can review the lower court's decision. Certiorari is most commonly used by the U.S. Supreme Court, which is selective about which cases it will hear on appeal. And THAT means it's likely the Supreme Court will hear the case on it's merits. What is a bigger issue this year, thanks to the democrats, than early ballot harvesting?
Stay tuned to see if the Court agrees to hear the case, the next big step. If so, Arizona can lead the country back to more honest elections.
That is totally awesome! There has been a great deal of work getting to this position. This may be the year the voters wake up - probably after the election, when they see the results of what happens with ballot harvesting. When people are educated, they understand how critical this issue is. I just pray we don't have to pay the price of learning the hard way.
